Throughout these Terms of Service, the terms “JustATees,” “we,” “us,” and “our” refer to Michal Vavřač, operating the JustATees online store.
These Terms of Service apply to your access to and use of justatees.com and to all purchases made through the website. By visiting the website, placing an order, or using any part of the website, you agree to these Terms of Service.
Please read these Terms carefully before placing an order. If you do not agree with them, you must not use the website or purchase products from us.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order.
A parent or legal guardian may place an order on behalf of a minor. By placing an order, you confirm that you are legally capable of entering into a binding agreement.
3. Our Products
JustATees sells apparel and related merchandise featuring original, artistic, humorous, historical, satirical, and fictional designs.
Unless expressly stated otherwise, our products are manufactured individually after an order is placed. We generally do not hold finished products in inventory.
Product mockups, lifestyle photographs, digital previews, and screen images are provided for illustration. Actual products may have minor variations in print placement, scale, color, garment texture, or appearance caused by manufacturing processes, garment size, lighting, or screen settings.
Minor variations that do not materially affect the product’s appearance or intended use are not considered manufacturing defects.
Product measurements may vary slightly within normal manufacturing tolerances. Customers are responsible for reviewing the size chart before ordering.
4. Satire, Parody, and Third-Party References
Some JustATees products contain satire, parody, humor, fictional scenarios, historical references, references to public events, or commentary on popular culture.
Unless expressly stated otherwise, JustATees is not affiliated with, sponsored by, approved by, or endorsed by any government agency, public institution, historical organization, company, brand, public figure, celebrity, political organization, or other third party referenced or suggested in a design.
The use of a name, event, theme, location, symbol, fictional concept, or historical reference does not imply an official relationship or endorsement.
Product descriptions and designs are offered for artistic, humorous, satirical, educational, or entertainment purposes and should not be interpreted as official statements, historical certification, professional advice, or factual claims.
5. Product Availability
All products and variants are subject to availability.
We may limit quantities, discontinue products, remove designs, change available sizes, or stop offering a product without notice.
Adding an item to your shopping cart does not reserve it. An order is not accepted until payment has been authorized and we send an order confirmation.
If a product becomes unavailable after an order has been placed, we may:
- offer a suitable replacement;
- ask whether you wish to wait;
- cancel the affected item; or
- cancel the order and issue a refund.
We will not substitute a materially different product without your consent.
6. Orders and Order Acceptance
When you place an order, you are making an offer to purchase the selected products under these Terms.
After receiving your order, we may send an automated confirmation. An automated confirmation acknowledges receipt of the order but does not necessarily mean that the order has been accepted or entered production.
We reserve the right to refuse or cancel an order for legitimate reasons, including:
- suspected fraud or unauthorized payment;
- incorrect pricing or product information;
- inability to verify billing or shipping information;
- product or variant unavailability;
- violation of these Terms;
- technical errors;
- orders that cannot legally be fulfilled; or
- intellectual-property or content concerns.
If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.
7. Order Changes and Cancellations
Because products are made to order, production may begin shortly after an order is submitted.
To request a change or cancellation, contact us immediately at shop@justatees.com and include your order number.
We will attempt to make the requested change, but we cannot guarantee that an order can be changed or canceled after payment has been processed or production has started.
Once production has begun, an order generally cannot be canceled because of a change of mind, an incorrect size selection, an incorrect color selection, or an incorrect product selection. However, eligible standard non-personalized products may still be returned after delivery under our 14-day return policy.
This section does not limit any rights that cannot legally be excluded.
8. Customer Information
You agree to provide complete and accurate information when placing an order, including:
- your full name;
- delivery address;
- billing information;
- email address; and
- any other information reasonably required to fulfill the order.
You are responsible for checking your order confirmation and promptly reporting any errors.
We are not responsible for delays, failed deliveries, or additional costs caused by incomplete, inaccurate, or outdated information supplied by the customer.
9. Prices and Currency
Unless otherwise stated, prices displayed for customers in the United States are shown in United States dollars.
Prices may change at any time. A price change will not affect an order that has already been accepted, except where an obvious pricing or technical error has occurred.
The final amount payable, including applicable shipping charges, taxes, and discounts, will be displayed during checkout before the order is submitted.
If a product is listed at an obviously incorrect price due to a typographical, technical, synchronization, or system error, we may cancel the affected item or order and provide a full refund.
10. Taxes, Customs Duties, and Other Charges
Applicable sales taxes or other taxes may be calculated and collected during checkout where required.
Depending on the delivery destination, fulfillment location, and applicable regulations, an order may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by government authorities or delivery providers.
Unless expressly stated at checkout, such charges are not included in the product price or shipping price and are the responsibility of the recipient.
We do not control charges imposed by customs authorities, states, municipalities, carriers, or other third parties.
11. Payment
Available payment methods are displayed during checkout.
By submitting payment information, you confirm that:
- the information is complete and accurate;
- you are authorized to use the selected payment method; and
- you authorize us and our payment service providers to charge the total order amount.
Payment may be subject to authorization, fraud screening, identity verification, and other checks performed by payment providers.
We do not guarantee that every payment method will be available for every customer or transaction.
12. Production and Fulfillment
Products may be printed, packed, and shipped by third-party production and fulfillment partners acting on our behalf.
The production location may vary depending on the product, availability, delivery destination, and production capacity.
An order containing multiple products may be divided into more than one package. Packages from the same order may arrive separately and may have different tracking numbers.
13. Shipping and Delivery
Estimated production, shipping, and delivery times may be shown on product pages, during checkout, in our Shipping Policy, or in an order confirmation.
Delivery dates are estimates unless we expressly state that a particular date is guaranteed.
If we determine that we cannot ship within a specifically promised timeframe, we will notify you and, where required, offer you the opportunity to:
- consent to the delay; or
- cancel the affected order for a full refund.
If no specific shipping timeframe has been provided, we will handle the order in accordance with applicable laws and regulations.
Delivery may be delayed by circumstances outside our reasonable control, including carrier delays, severe weather, natural disasters, customs processing, strikes, public emergencies, incorrect addresses, or transportation disruptions.
Such circumstances do not remove any right you may have to cancel an unshipped order or receive a refund where required by applicable law.
14. Tracking and Delivery Confirmation
Where tracking is available, tracking details will be sent to the email address provided with the order.
Customers are responsible for monitoring tracking information and ensuring that the delivery location is secure and accessible.
A package marked as delivered by the carrier will generally be treated as delivered. If you cannot locate a package marked as delivered, contact us promptly so that we can assist with a carrier investigation.
We are not automatically responsible for theft, loss, or damage occurring after a package has been correctly delivered to the address supplied by the customer, except where applicable law provides otherwise.
15. Incorrect Addresses and Unclaimed Packages
The customer is responsible for providing a complete and correct delivery address.
If an order is returned because of:
- an incorrect or incomplete address;
- refusal of delivery;
- failure to collect the package;
- an inaccessible delivery location; or
- another circumstance attributable to the recipient;
the customer may be responsible for the cost of reshipping.
Original shipping charges are generally non-refundable in these circumstances.
A replacement or reshipment may not be available if the returned item is not recoverable or if the request is made after the applicable claim or storage period.
16. Returns, Replacements, and Refunds
Returns, replacements, exchanges, cancellations, and refunds are governed by our separate Refund Policy, which forms part of these Terms.
Eligible standard non-personalized products may be returned within 14 calendar days after delivery, provided that the product meets the eligibility requirements stated in the Refund Policy.
For a voluntary return caused by a change of mind, an incorrect size selection, an incorrect color selection, or an incorrect product selection, the customer is generally responsible for return shipping costs.
We do not charge restocking or return-handling fees.
Damaged, defective, materially misprinted, or incorrect products must be reported within 30 calendar days after delivery. If the claim is approved, we will provide an appropriate remedy at no additional product or standard shipping cost to the customer.
All returns must be authorized before they are shipped. The registered business address is not automatically the return address.
Nothing in this section limits any consumer rights that cannot legally be excluded.
17. Promotions and Discount Codes
Promotions, discount codes, gift offers, and special prices may be subject to additional conditions.
Unless expressly stated otherwise:
- discount codes cannot be exchanged for cash;
- only one discount code may be used per order;
- discounts cannot be applied retroactively;
- promotions may be limited by date, product, location, or quantity; and
- we may cancel a promotion affected by misuse, fraud, or technical error.
18. Gift Cards and Store Credit
Gift cards and store credit, where offered, may be used only in accordance with the conditions displayed at the time of purchase or issue.
Gift cards and store credit are not redeemable for cash except where required by applicable law.
Refunds for purchases originally paid with a gift card may be returned to the gift card or issued as store credit where legally permitted.
19. Intellectual Property
The website and its content, including designs, illustrations, graphics, photographs, logos, product descriptions, text, layout, and branding, are owned by or licensed to JustATees and are protected by applicable intellectual-property laws.
You may use the website only for personal, non-commercial shopping purposes.
You must not, without prior written permission:
- reproduce or sell our designs;
- copy product artwork;
- remove copyright or attribution notices;
- use website content to create competing products;
- scrape or systematically extract website data;
- use our branding in a misleading manner; or
- represent yourself as associated with JustATees.
Purchasing a product does not transfer any intellectual-property rights in the printed design.
20. Reviews, Comments, and Other Submissions
If you submit a review, photograph, comment, suggestion, or other content to us, you confirm that you have the right to submit it and that it does not violate another person’s rights.
You grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, adapt, and use the submitted content for operating and promoting JustATees.
We may remove content that is unlawful, misleading, abusive, discriminatory, infringing, fraudulent, or unrelated to the relevant product or service.
We will not knowingly publish fabricated customer reviews or materially alter a review in a way that changes its meaning.
21. Prohibited Use
You must not use the website:
- for unlawful or fraudulent activities;
- to infringe intellectual-property rights;
- to distribute malicious software;
- to interfere with website security;
- to obtain unauthorized access to systems or data;
- to submit false payment or identity information;
- to harass or harm another person;
- to collect personal information unlawfully; or
- in violation of applicable sanctions, export controls, or trade restrictions.
We may suspend or terminate access when we reasonably believe these Terms have been violated.
22. Third-Party Services and Links
The website may use or link to services operated by third parties, including payment processors, fulfillment providers, shipping carriers, analytics providers, social networks, and ecommerce technology providers.
Third-party services may have their own terms and privacy practices.
We are not responsible for the independent content, policies, security, or availability of third-party websites or services, except to the extent that applicable law makes us responsible.
23. Website Availability and Errors
We attempt to keep the website accurate and available, but we do not guarantee that it will always operate without interruption or error.
We may correct typographical errors, inaccurate descriptions, availability errors, pricing errors, or other mistakes at any time.
We may temporarily suspend access for maintenance, security, updates, or circumstances beyond our control.
24. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website is provided on an “as available” basis.
Except for warranties expressly stated by us or imposed by applicable law, we do not provide additional warranties regarding uninterrupted website operation, compatibility with every device, or the absence of technical errors.
Nothing in these Terms excludes statutory warranties, mandatory consumer protections, or other rights that cannot legally be waived.
25. Limitation of Liability
To the maximum extent permitted by applicable law, JustATees will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or purchase of a product.
Where liability cannot be excluded, our aggregate liability relating to a particular order will generally be limited to the amount paid for that order.
This limitation does not apply where liability cannot legally be limited, including liability arising from intentional misconduct, gross negligence, personal injury, fraud, or mandatory consumer-protection law.
Some jurisdictions do not allow certain limitations or exclusions. In those jurisdictions, the limitations apply only to the extent legally permitted.
26. Indemnification
You agree to be responsible for losses or claims resulting from your unlawful use of the website, your infringement of another person’s rights, or content that you submit in violation of these Terms.
This section does not apply to ordinary consumer complaints or limit rights that cannot legally be excluded.
27. Force Majeure
We will not be responsible for a failure or delay caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, public-health emergencies, government action, carrier disruptions, power failures, internet outages, or failures affecting essential suppliers.
We will take reasonable steps to minimize the effects of such circumstances.
This section does not remove any right to a refund for an unfulfilled order where required by applicable law.
28. Governing Law
These Terms and the contractual relationship between you and JustATees are governed by the laws of the Czech Republic, without regard to conflict-of-law rules.
However, this choice of law does not deprive a consumer of mandatory protections provided by the laws that apply to the consumer and cannot legally be waived by contract.
Any dispute will be submitted to the competent courts of the Czech Republic unless applicable mandatory law gives the consumer the right to bring proceedings in another jurisdiction.
29. Informal Resolution of Disputes
Before starting formal proceedings, we encourage customers to contact us at shop@justatees.com.
Please include your order number, a description of the issue, and the resolution requested. We will attempt to respond and resolve the issue in good faith.
Nothing in this section prevents either party from exercising rights or remedies available under applicable law.
30. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, products, services, or legal obligations.
The updated version will be posted on this page with a revised “Last updated” date.
Changes will apply prospectively and will not materially reduce rights relating to an order already accepted unless required by law or agreed with the customer.
31. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain effective.
The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.
32. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
33. Entire Agreement
These Terms, together with our Refund Policy, Shipping Policy, Privacy Policy, Legal Notice, and any conditions shown during checkout, constitute the agreement relating to your purchase and use of the website.
